VOICE YOUR COMPLAINTS AT THE HEARING ON BLIZZARD CLEAN-UP IN BROOKLYN

Now that the clean-up from the blizzard is done, it's time to let the City Council hear first-hand about the specific problems we encountered in our neighborhood. City Councilmember Brad Lander writes

Tomorrow morning, the City Council will be holding its first hearing to examine why the City's cleanup efforts after the December 26th blizzard were so much worse than in past storms, and what must be done to address these failures going forward. If you are interested, you can watch the hearing live.

In addition to tomorrow's hearing near City Hall, the Council will be holding community-based hearings in each borough, to hear directly about the problems you faced during the storm. The Brooklyn hearing will take place on Wednesday, January 19th, at 6 p.m. at Brooklyn Borough Hall, 209 Joralemon Street. More information on the hearings can be found here.

In advance of these hearings, my office as compiled a "39th District Blizzard Cleanup Report" that examines the response in the neighborhoods of the 39th District (Cobble Hill, Carroll Gardens, Park Slope, Windsor Terrace, Kensington, and Borough Park).

The report is based on the nearly 400 complaints we received from you in the week following the storm – including those whose streets remained uncleared for more than 5 days after the storm – as well as on-the-ground observations by my office, dozens of follow-up conversations (with residents, key institutions, sanitation workers, and others), and a summary of available news reports.

The City Council hearings and follow-up investigations will examine many key questions, such as why a "snow emergency" was not declared, what the chain-of-command was at key decision-points, and what the impact of staffing reductions and equipment changes was in this cleanup.

Our local report will hopefully help to shine a light on issues that arose specifically in our communities, including:

• The response of DSNY Brooklyn District 12 (Kensington, Borough Park) was much slower than District 6 (Cobble Hill, Carroll Gardens, Park Slope) or District 7 (Windsor Terrace).
• Inadequate technology meant that Sanitation did not know when a block has been plowed, and which streets remained uncleared.
• Lack of coordination between tow and plow operations severely hobbled the cleanup, and left many blocks unplowed.
• The City’s 911/EMS systems were overwhelmed, which delayed emergency response in many cases, including in one possibly-preventable death in Kensington.
• The City’s response failed to prioritize of the removal of snow around hospitals and subway entrances.

It is essential that we understand the mistakes that caused the inadequate response, require accountability for these errors, and identify and correct systemic problems before the next major snowstorm. Finally, I would be remiss if I did not mention one of the only highlights of the storm aftermath, which was the heroic citizen response. During the week following the storm, as the inadequate City response left many people stranded, countless volunteers aided their neighbors in ways large and small, whether by shoveling sidewalks for a neighbor, or by contributing to the volunteer emergency response. Our district never fails to step up in a time of emergency, and I want to thank everyone for the work that you did to help our community.

SATURDAY MORNING SHOOTING ON E. 3RD STREET NEAR CORTELYOU ROAD

The NYPD is investigating a shooting which occurred in Kensington on Friday night / early Saturday morning. The shooting took place at 651 East 3rd Street, near Cortelyou Road.

FlatbushScoop.com has learned that the incident was some type of fight between two individuals, who apparently knew each other. The victim was shot through the window. The NYPD’s 66 Precinct called for a Level 1 Mobilization immediately after the incident, which happened around 2:00AM.

At the time of the incident, the NYPD was looking for a African American male suspect. It is unknown if he (or anyone else) has been apprehended and taken into custody.

The victim is reported to be in stable condition.

Yesterday's blog post described the crime as a shooting/stabbing, but no stabbing took place.

Petey is a very playful, spunky, 3-year-old Pit Bull Terrier mix. Petey was found tied up on New Utrecht Avenue near an old grooming salon. He had a green sweater on and a note attached to his collar. Apparently, Petey's previous owner thought the grooming salon was still open and would take Petey in.

The note said that Petey was being left there because the new landlord wouldn't allow dogs. It went on to say that Petey was a good dog--nervous at first but warms up quickly and becomes a lap dog. A shelter favorite, Petey would love to meet you!

CITY READIES FOR TOMORROW'S SNOW

Two to six inches of snow are expected to fall tomorrow. In a press conference today, Mayor Bloomberg said

To help improve communication during our response, we also are piloting a program tomorrow in which we are installing GPS tracking devices in 50 sanitation trucks assigned to the ‘Brooklyn 14’ garage.  This garage covers areas of Midwood, Flatbush, Ditmas Park, and parts of Kensington – some of the neighborhoods hit hardest in last week’s storm.

SANITATION DISTRICT 12'S SNOWSTORM RESPONSE

Statement from Councilmember Brad Lander on Sanitation District 12’s Snowstorm Response:

After last week’s terrible snowstorm, my office received hundreds of complaints about the deeply inadequate snow removal throughout my City Council district. The area covered by Sanitation District Brooklyn 12 (Kensington and Borough Park) made up the overwhelming majority of those complaints in the second half of the cleanup effort, despite the fact that District 12 makes up only about one-third of my Council district. It was clear as the storm cleanup went on that District 12 was underperforming relative to other districts, as many streets in Kensington and Borough Park were still unplowed by Friday, December 31.

The overwhelming system failure that occurred during this storm came from the top, and the mayor and sanitation commissioner need to be held accountable. But today we did learn about one action of accountability that happened locally, as the Sanitation Supervisor of District Brooklyn 12 has been sanctioned, and reassigned to a different district. Clearly at District 12 there was a leadership failure as compared to other districts in Brooklyn and the residents of Kensington and Borough Park have a right to expect more. It seems as though the Sanitation department has taken into account some of the local concerns, and is beginning to take steps toward improving District 12.

A LETTER TO THE MTA DEMANDING BETTER ALTERNATIVE SERVICE FOR THE F AND G TRAINS

DON'T CHANGE YOUR ROUTE YET: F AND G TRAIN CHANGES POSTPONED FOR ONE WEEK

From City Councilmember Brad Lander's office:

Our office has just been informed by the MTA that due to the snowstorm forecasted for Saturday, they will be delaying the track work scheduled for this weekend on the F and G lines.

This means that the weekend shuttle bus service between Jay Street and Church Ave which was previously scheduled for this weekend has now been postponed to the weekend of January 15 and 16.

The 5-month northbound local F/G train service suspension at the Fort Hamilton Parkway and 15th Street stops which was scheduled to begin on January 10 will now begin on January 17.

Additionally, in response to our request that the MTA explore alternative service to replace the partially-closed stations during this time, MTA officials have agreed to meet with me and other concerned elected officials next week.

We are looking forward to this meeting and will continue to urge them to consider alternatives besides having to ride the train back to the Church Ave station in order to head towards Manhattan.

We will continue to keep you updated as more progress is made on this issue.

RULES OF THE ROAD FOR BICYCLISTS ARE BEING ENFORCED

Two of yesterday's blog posts were about the bicycle enforcement initiative by the Police Department: "A Message to Bicycle Riders" and "Follow-up Message to Bicycle Riders."

The story behind increased enforcement of the rules of the road lies in a Gothamist article from November 2010, "With Cycling Deaths on Rise, NYPD Cracks Down on Cyclists":

There were at least 19 cyclist fatalities in NYC through October 31, seven more than in all of 2009, according to an analysis of NYPD data conducted by the Wall Street Journal. And during the same period, 3,505 bikers were injured in crashes with motor vehicles, more than last year's total and up 20% compared to the first 10 months of last year.

In an article in today's edition of The Brooklyn Paper, "Bikelash! Cops to crack down on two-wheelers," the police hastened to add that "the public has no reason to fear that the NYPD’s new mission against errant bicyclists will hamper their ability to stop other crimes like murder, rape, muggings, burglar and iPhone thefts."

Under New York State law, bicycles are defined as vehicles, and bicyclists are subject to specific traffic rules. A few of those rules are:

• No person shall ride or operate a bicycle upon any sidewalk area unless permitted by sign. This prohibition shall not apply to the operation of bicycles with wheels of less than 26 inches in diameter upon the sidewalk by children of 12 years or less in age.
• No person shall operate or ride a motor vehicle or bicycle without having his/her hand [at least one hand] on the steering device or handle bars.
• While working, commercial bicyclists must wear a properly fitted bicycle helmet.
• Bicyclists cannot ride against the flow of traffic.
• Bicyclists cannot wear more than one earphone attached to a radio, tape player or other audio device while riding.

The Department of Transportation offers bicycle safety tips , including this information:

Cyclists in New York City must

1. Ride on the street, not on the sidewalks (unless rider is age 12 or younger and the bicycle's wheels are less than 26 inches in diameter).
2. Ride with traffic, not against it.
3. Obey all traffic signals, signs and pavement markings. Cyclists must come to a complete stop at red lights and stop signs. Cyclists are required by law to exercise due care to avoid colliding with pedestrians, motor vehicles or other cyclists.
4. Use marked bike lanes or paths when available, except when making turns or when it is unsafe to do so, etc. If the road is too narrow for a bicycle and a car to travel safely side by side, cyclists have the right to ride in the middle of the travel lane. Bicycling is permitted on all main and local streets throughout the City even when no designated route exists.
5. Not ride on expressways, drives, highways, interstate routes and thruways unless authorized by signs.
6. Not wear more than one earphone attached to an audio device (e.g. radio, ipod, walkman)
7. Use the following safety and visibility equipment:
   • White headlight and red taillight must be used from dusk to dawn
   • Bell or horn (not whistle)
   • Working brakes
   • Reflective tires or reflectors
   • Helmets must be worn by children age 13 or younger, and helmets are strongly recommended for all others.

FELONIES REPORTED TO THE 66TH PRECINCT, DECEMBER 27TH THROUGH JANUARY 2ND

Three felonies were reported to the 66th Precinct for Kensington during the week of December 27th through January 2nd:

Grand Larceny: On December 30th, a thief walked up to a sixteen-year-old boy at the corner of E. 3rd Street and Avenue C, took his cellphone out of his hand, and fled. No arrest was made.

Grand Larceny: On January 1st, a thief removed clothes, money, and jewelry from a vehicle parked in front of 300 Ocean Parkway, between Beverley Road and Avenue C. No arrest was made.

Robbery: On January 2nd, at Church and McDonald avenues, two approximately fourteen-year-old boys followed a twenty-three-year-old woman and then put her in a headlock, hit her in the face, and took her cellphone and $15 from her purse. No arrest was made.
